RaceCut is operated by 3024 Limited, a company registered in England and Wales (company number [company number]) with its registered office at [registered office address] (“RaceCut”, “we”, “us”). You can reach us at hello@racecut.app.
RaceCut is a separate company from Jammable. Where you choose to have a race voiced, that voice conversion is performed by Jammable (jammable.com) as a third-party service — see section 5.
By using racecut.app or any RaceCut tool (the “Service”) you agree to these terms and to our Privacy Policy. If you don’t agree, don’t use the Service. If you use the Service on behalf of a company or channel, you confirm you have authority to bind it, and “you” includes it.
You must be at least 13 to use the Service. If you are under 18, you confirm a parent or guardian has read these terms and agreed to them on your behalf. Paid plans, when offered, require you to be 18 or older.
RaceCut is a creative tool. It simulates a marble race and renders it as a short vertical video in your own browser: the physics, the rendering and the video encoding all run on your device. RaceCut does not host a catalogue of songs, voices or finished videos. What you make is yours to keep and to publish wherever you like, subject to section 4.
The Service is in beta. Features, formats, limits and pricing may change, and things may occasionally break. We may add, alter or remove features, and may set fair-use limits (for example, on how many voiced races you can make per hour), at any time.
“Your Content” means anything you bring to the Service: songs and audio files, Jammable links, marble names, artwork, and the videos you generate. You keep all rights you have in Your Content. You give us only the limited licence needed to run the Service for you (for example, to relay your instructions to Jammable and to display artwork on the marbles).
You are solely responsible for Your Content. By using the Service you confirm that:
We don’t review Your Content before it is processed and we don’t take responsibility for it. We may refuse, limit or stop processing any content, and may suspend accounts, where we reasonably believe these terms or the law are being broken. RaceCut is not affiliated with, endorsed by or sponsored by any recording artist, label or publisher.
If you import a Jammable link or choose “Voice it with Jammable”, the voice conversion is carried out by Jammable using RaceCut’s developer access to Jammable’s public API. In that case: your song is uploaded from your browser directly to Jammable’s storage; RaceCut sends Jammable only the instructions needed for the job (which voices, when each should sing, which part of the song); and Jammable returns the voiced audio to your browser, where it is combined with the video. Jammable’s own terms and privacy policy apply to that processing, and Jammable may keep the voiced result at an unlisted link on its platform. We are not responsible for Jammable’s availability or output. RaceCut currently covers the cost of this processing; we may introduce limits or charges for it with notice.
The Service may link to other sites and services. We don’t control them and aren’t responsible for them.
You must not:
RaceCut, the racecut.app site, the race engine, courses, designs, text and branding are owned by us or our licensors and are protected by copyright and other laws. Apart from Your Content and the videos you generate, nothing here gives you any right to our IP. If you send us feedback or ideas, we can use them without obligation to you.
The Service is currently free while in beta. If we introduce paid plans, the price, billing period and what is included will be shown before you pay, and these terms will apply together with any plan-specific terms shown at checkout. If you are a consumer in the UK or EU you have statutory rights, including a 14-day right to cancel digital services (which you may lose once you ask us to start providing the service within that period). Nothing in these terms limits those rights.
If you believe content created with the Service or found on racecut.app infringes your rights, email hello@racecut.app with: your name and contact details; the work you say is infringed; the material you are complaining about and where it is; a statement that you believe in good faith the use is not authorised; and a statement that the information is accurate and you are the rights holder or authorised to act for them. We act on valid notices, and we suspend or terminate repeat infringers. Because finished videos live on your device and on the platforms you post to, requests about a published video usually need to go to that platform as well.
The Service is provided “as is” and “as available”. Races are simulated, so results vary each run; rendering depends on your device and browser (a current desktop Chrome or Edge is required); and third-party services may be slow or unavailable. To the extent the law allows, we exclude all warranties and conditions not expressly stated here. Nothing in this section limits your statutory rights as a consumer, including the right for digital content to be as described, fit for purpose and of satisfactory quality.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or anything else that cannot lawfully be excluded.
Subject to that, we are not liable for: any loss that was not foreseeable when you started using the Service; loss caused by Your Content or your breach of these terms; the acts or omissions of Jammable or any other third party; or, if you use the Service for business purposes, any loss of profit, revenue, business, goodwill or data, or any indirect or consequential loss. If you use the Service for business purposes, our total liability to you in any 12-month period is limited to the greater of £100 and the amount you paid us for the Service in that period.
If you use the Service for business purposes, you agree to indemnify us against claims, losses and costs arising from Your Content or your breach of sections 4 to 6.
You can stop using the Service at any time. We may suspend or end your access if you break these terms, if we reasonably need to protect the Service, other users or third parties, or if we discontinue the Service (in which case we will give reasonable notice where practical). Sections 4, 7, 9 to 11 and 14 survive.
We may update these terms. If a change is material we will post it here with a new effective date and, where we can, tell you in the product. Continuing to use the Service after a change means you accept it.
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction — except that if you are a consumer resident elsewhere in the UK or in the EU, you may also rely on the mandatory consumer protections of, and bring proceedings in, the country where you live.
